Count 2 That on or about the 11th day of June, 2012, at or near Hinton, in the Province of Alberta, did use tetrachloroethylene for dry cleaning in a dry-cleaning machine operated in a dry-cleaning facility that was not equipped with a tetrachloroethylene-impermeable secondary containment system encompassing at least the entire surface under each dry-cleaning machine, tank or other container containing tetrachloroethylene, waste water or residue and capable of containing at least 110% of the capacity of the largest tank or container within the containment system as required by section 5(f)(i) of the Tetrachloroethylene (Use in Dry Cleaning and Reporting Requirements) Regulations contrary to section 272(1)(a) of the Canadian Environmental Protection Act, 1999. |
