On February 18th, 2016, the Canada Border Services Agency (CBSA) Calgary Commercial Office contacted Wildlife Enforcement Directorate-Prairie & Northern Region, Calgary, stating that they had five (5) boxes of what they believed to be a shipment of coral species being imported without a Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) permit. Environment and Climate Change Canada (ECCC) Enforcement Officers inspected the shipment and found that it contained approximately 115 kilograms of blue and stony coral. Both of these species are regulated under CITES, and, as a result, all imports are subject to strict permitting requirements to ensure that trade does not threaten the survival of the species in the wild.
Following a year-long investigation, Wildlife Officers filed two counts against 2-Eleven Buyers Inc., both under the Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act (WAPPRIITA). As part of an agreed statement of facts, 2-Eleven Buyers Inc. pleaded guilty to Count 2 and was ordered to pay a fine of $10,000.00 to the Government of Canada’s Environmental Damages Fund. 2-Eleven Buyers Inc. was also ordered to notify ECCC of all imports containing plant and animal species. This notification was to be made at least 5 days before the import. Such an order was to remain in effect for a period of two (2) years from the date of conviction. |

On 04 February 2018 before On, WHEREAS 2-Eleven Buyers Inc. has pled guilty to a charge under s.6(2) of the Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act (hereinafter referred to as WAPPRIITA) being Count Two on Information No. 180205536P1; AND UPON HEARING the joint submission of counsel for the Public Prosecution Service of Canada, and counsel for 2-Eleven Buyers Inc. THIS COURT ORDERS, 2-Eleven Buyers Inc. to pay a fine of ten thousand dollars ($10,000) pursuant to s. 22(l) of WAPPRIITA. Payment of the amounts ordered hereunder will be made to the Clerk of the Court in Calgary, Alberta and full payment will be made to the Clerk of the Court on or before, 2019.
THIS COURT FURTHER ORDERS, that, pursuant to s.22(6)(h) of WAPPRIITA, all employees, officers and directors of 2-Eleven Buyers Inc., when acting on behalf of 2-Eleven Buyers Inc., report for a period of two years, all attempts to import plants, animals, or their derivatives, as they are defined in s. 2 of WAPPRIITA, to Environment and Climate Change Canada. This will be done by sending, no later than five business days in advance of any importation, details about the specific nature of each good to be imported, along with the manifest, packing slip or invoice accompanying the good, to the attention of the Operations Manager, Wildlife Enforcement Directorate, Environment and Climate Change Canada. Until otherwise notified, this can be done by providing the required information by email to ECCC Wildlife Enforcement Directorate. |
